TERMS AND AGREEMENTS OF CUSTOM MADE ORDERS
| 1. | All custom made orders are done on a first come first served basis. |
| 2. | The Client must agree to Design, Price and Fabric when order is placed. |
| 3. | A 50 % deposit is required with an order, the balance to be paid upon acceptance of the first fit. |
| 4. | Consultation with The Designer is scheduled by appointment only. |
| 5. | Appointments are arranged by the Design House based upon availability and the Designer's schedule, to coincide with The Client's availability. |
| 6. | All fittings are done by appointment only. |
| 7. | Added on requests to garments after the order is given will be entertained based upon time factors. Such requests will attract additional costs to the Client and in some instances a change of delivery date. |
| 8. | The Company retains the right to reschedule an appointment providing the delivery date is retained. |
| 9. | A Custom Made Order is considered to be an original design or a copy of a house sample of the Designer and not an interpretation of a Client's request. |
| 10. | A Client Order is considered to be an interpretation of a Client's creative idea or a copy of a magazine photo . |
| 11. | While The Company would accept a Client Order it does not hold itself responsible for any indecision or alteration of design structure on the part of the Client, based upon visual misinterpretation of a standardised model's photo fit compared to the reality of the Client's body structure, once the order is placed. |
| 12. | The Company agrees to hold itself responsible for up to three fittings in the execution of what it considers to be an acceptable fit. |
| 13. | An ACCEPTABLE FIT is considered to be THE FIT based upon the interpretation of the Designer's Look of the Moment, which is structured from standardised measurements of the trade and fitted on a house model for accuracy. |
| 14. | 50 % of a A GOOD FIT is the responsibility of the Client to prepare herself /himself with the correct undergarments to enhance any bodily defects she/he may have. These will be discussed with her/him when body measurements are taken. The other 50% of a GOOD FIT will be the responsibility of the Designer to execute a garment of acceptable market quality, structured to fit in the manner in which the sample or design is/was interpreted by the Designer. |
| 15. | Custom made orders are accepted upon The Client's approval of the above terms and agreements. |
| 16. | In the resolution of any dispute of a Client Order/Custom Made Order, the acceptance relinquishes the Client's right to withhold part/all of any payment for any such transaction. |
| 17. | CPFS shall not be responsible for manufacturing defects in materials supplied by the Client |
| 18. | The Client shall take all reasonable action to ensure that CPFS designs are not duplicated by the Client or any third party. |
TERMS AND CONDITIONS FOR PARTICIPATION IN A FASHION SHOW
| 1. | Garments must only be shown on professional models from a reputable agency. | 2. |
Two weeks prior to the show, names and measurements of models must be received by the designer.|

Fittings are done by appointment only. |
4. |
Collection and return of garments is the responsibility of the Fashion Show Committee. Alternatively this service can be provided by us at a negotiable cost. |
5. |
A dry-cleaning/deodorizing cost per garment must be paid in advance of collection. |
6. |
Upon acceptance of a Collection for showing, the fashion show committee holds itself responsible for full security, soilage, damages and/or disappearance of any garments. |
7. |
Adequate facilities must be provided for storage of clothes and accessories in the following manner:- |
  a. A table of approximately 6 ft in length must be provided for layout of accessories and notions.   b. A hanging rack must be provided for clothing.   c. A standing mirror of approximately 3 ft in length for use by models.   d. The room must be air-conditioned or equipped with fans plus a minimum of three chairs for wardrobe staff.

Trained wardrobe staff will be provided by the designer, the cost of which will be billed to the Committee . |

The Designer retains the rights to any photographic material of her clothing used for promotional purposes and/or press releases. |

TERMS OF AGREEMENT FOR WHOLESALE ORDERS Buyer agrees to the following conditions: ACCEPTANCE OF ORDERS All orders are subject to acceptance by CLAUDIA PEGUS DESIGNS LTD. Acceptance is based on existing price, product availability and delivery conditions. Orders will only be accepted from a House Design and not a Client's Design. A minimum order per style, per colour is 3 pieces. Orders under $ 1000.00 US will not be accepted. FREIGHT All garments are shipped in polyurethane bags. Freight and shipping charges are F.O.B., P.O.S., Trinidad. PRICES A 50 % deposit is required on all orders before manufacturing is commenced. The balance is to be paid prior to shipping for first time buyers. Credit facilities can only be given to long term Clients placing orders of $ 8000.00 US and above. DELIVERY Delivery dates will be determined upon availability of stock and size of order. LABELLING House Designs will carry all standardised labelling required by the country of origin plus the Designer Label CPFS and / or Claudia Pegus. Buyers are prohibited from removing the Designer Label for any form of re-labelling. Such action can result in legal proceedings taken against any offenders. Buyers are prohibited from reproducing / copying and / or changing any part of a CPFS / Claudia Pegus design without the Designer's permission in writing. Considerations of Territorial exclusivity can only be negotiated if the Client agrees to purchase substantial amounts over an extended period under a contractual agreement. RETURN GOODS POLICY All claims must be made within 7 days of shipping goods. Return items must be shipped Courier Ground or Cheapest Shipping Alternative. Return merchandise must be accompanied by an authorisation number issued by CLAUDIA PEGUS DESIGNS LTD. All return merchandise must be received by CLAUDIA PEGUS DESIGNS LTD in a clean and neat condition. Returned items that are not received in good condition will be returned to customer at customer's expense. Goods ordered are to be manufactured for Buyer. All orders for manufacture are binding and may not be cancelled after manufacturing has commenced. CLAUDIA PEGUS DESIGNS LTD. must ship by completion date and purchase order shall remain effective. All delinquent accounts will bear interest at 1.5% per month. If professional services are needed to effect collection Buyer shall pay Collection Agency or Attorney's fees and costs. The authorised individual signing purchase order personally guarantees payment. CLAUDIA PEGUS DESIGNS LTD. retains a Vendors Lien against all merchandise until all accounts due are paid. |
